These Terms of Service ("Terms") govern your use of Swap & Grow (the "App"), developed and operated by KTM Studio ("we", "us", or "our"). By accessing or using the App, you confirm that you are at least 13 years old and agree to these Terms in full.
If you do not agree to these Terms, you must not use the App. Your continued use of the App following any changes to these Terms constitutes acceptance of the revised Terms.
Swap & Grow is a habit-replacement iOS application that helps users replace bad habits with good ones through streak tracking, a virtual growing tree, accountability buddies, and community groups.
The App includes the following features:
We reserve the right to modify, suspend, or discontinue any part of the App at any time with reasonable notice where possible.
You may use the App anonymously or create a registered account using your email address, Apple Sign In, or Google Sign In.
Account responsibilities:
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being misused.
Swap & Grow offers optional Premium subscriptions that unlock additional features. Subscriptions are managed through Apple's App Store and processed by RevenueCat.
You agree to use Swap & Grow only for lawful purposes and in accordance with these Terms. You must not:
Swap & Grow includes community features (groups, posts, comments, buddy chat). When using these features, you agree not to post content that:
We reserve the right to remove content and suspend users who violate these guidelines without prior notice. You can report content that violates these guidelines via the in-app report function.
User content. You retain ownership of content you post. By posting, you grant KTM Studio a non-exclusive, royalty-free licence to display your content within the App for the purpose of providing the service.
The App, including its design, code, graphics, tree animations, and all other content created by KTM Studio, is owned by KTM Studio and protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to use the App on your personal Apple device(s) for personal, non-commercial purposes. This licence does not include the right to:
Swap & Grow is provided "as is" and "as available" without warranties of any kind, express or implied.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses. We are not responsible for any data loss arising from App errors or interruptions.
To the maximum extent permitted by applicable law, KTM Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the App.
Our total liability to you for any claim arising out of or related to these Terms or the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $10 USD if you have not made any payments.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.
You may stop using the App and delete your account at any time via Profile → Delete Account. Upon account deletion, your personal data is removed within 30 days as described in our Privacy Policy.
We may suspend or terminate your access to the App immediately, without prior notice, if you materially breach these Terms. Upon termination, your licence to use the App ends immediately.
Sections 7 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), and any other provisions that by their nature should survive, will survive termination.
These Terms are governed by the laws of Nepal, without regard to conflict of law principles. Any disputes shall first be attempted to be resolved informally by contacting us.
We may update these Terms from time to time. We will notify you of material changes via an in-app notice at least 7 days before the changes take effect. Continued use after that date constitutes acceptance.
